The Code of Conduct

The Real Estate Agents Act (Professional Conduct and Client Care) Rules 2012 (Code of Conduct) set out the standard of professional conduct and client care required of agents, branch managers and salespersons.

Compliance

You must comply with the requirements of the Real Estate Agents Act 2008, the Regulations and the Real Estate Agents Act (Professional Conduct and Client Care) Rules 2012 (the Code of Conduct) at all times when carrying out all residential, commercial, industrial and rural property real estate transactions.

You should read the Code of Conduct in conjunction with the Act. Breaking the law set out in the Act or falling short of the standards set out in the Code of Conduct may constitute unsatisfactory conduct or misconduct.

Copies of the Conduct must be displayed in real estate offices and be available to anyone on request.

Comply with the Act and the Code of Conduct

You will be expected to comply with the Act and Code of Conduct in all areas of your work. There are specific requirements related to:
  • agency agreements
  • sale and purchase agreements
  • the agency agreement guide and the sale and purchase agreement guide
  • conflict of interest
  • trust accounts
  • display of information about a business.
